On 31 October 2013, 10 members of the Peruvian Congress introduced a bill “to promote digital inclusion and implementation of Free Software in State institutions” (Ley que Promueve la Inclusión Digital y la Implementación del Software Libre en las Instituciones del Estado, available in Spanish as a PDF of the scanned document [4]). These Peruvian congressmen are members of the coalition headed by the President of the Republic who was elected in 2011. This bill deals with the implementation of Free Software by State institutions.

El Congresista de la República Josué Manuel Gutiérrez Cóndor miembro del grupo parlamentario Nacionalista Gana Perú, y los congresistas que suscriben, ejerciendo el derecho de iniciativa legislativa, que confiere el artículo 107 de la Constitución Política del Estado y conforme a lo dispuesto por los artículos 75 y 76 del Reglamento del Congreso de la República, presenta el siguiente proyecto de Ley:
Ley que promueve la inclusión digital y la implementación del software libre en las instituciones del estado.

Ha dado la ley siguiente:
Artículo 1.- Objeto de la Ley
El Estado peruano a través de las instituciones y empresas del estado, emplearan prioritariamente el software libre en sus planes de educación, equipamiento de informática, sistemas y proyectos, garantizando la estandarización en uso de formatos abiertos, la interoperatividad interinstitucional en los procesos de intercambio de datos, información y documentos; en los órganos y entes del estado que integre todos los sectores del gobierno así como el respeto a los derechos de la propiedad intelectual.
Artículo 2.- Aplicación del Software Libre
Las entidades de la administración pública deben iniciar el proceso de migración gradual y progresiva hacia la implementación y utilización del software libre en sus diferentes opciones en su manejo de información y manejo de datos, el poder ejecutivo creara "observatorios de control", a fin de vigilar y controlar el cumplimiento de la presente ley.
Artículo 3.- Responsabilidad Legal y Administrativa
La oficina nacional de gobierno electrónico e informática ONGEI serán responsables por el cumplimiento de las disposiciones de la presente Ley.
Artículo 4.- Independencia
Las instituciones del Estado no podrán adquirir soportes físicos (hardware), maquinarias o contratar con equipos que obliguen a utilizar solo determinado tipo de software, o que de alguna manera limiten la aplicación del software libre, en el caso que no existan soportes para dichos equipos, esta certificación deberá ser extendida por la unidad responsable - ONGEI.
Artículo 5.- Excepciones
Cuando no se disponga de programas de software libre adecuados a cumplir una determinada labor o cuando su uso pueda causar incompatibilidad operacional con otros programas utilizados en el sector público, se podrá usar el software propietario previo respaldo de estudios y dictámenes técnicos por parte de la unidad encarga - ONGEI.
Artículo 6.- Permisos Educativos
Las entidades educativas dependientes del estado, ya sean colegios universidades, institutos de educación superior, técnicos, pedagógicos, agropecuarios y demás, deben incluir en su estructura curricular la utilización del software libre.
Artículo 7.- Capacitación
La oficina nacional de gobierno electrónico e informática ONGEI garantiza el principio de especialización en tecnologías, así como la capacitación y administración a funcionarios y administrativos del sector público, en condiciones de neutralidad y vigencia tecnológica.
Disposición transitoria
Artículo 1.- Reglamentaría
El poder ejecutivo reglamentara en un plazo de 180 días, les condiciones, tiempos, y formas de migración de la situación actual, al uso del software libre por parte de todas las instituciones del estado, para el fiel cumplimiento de la presente ley.
Disposiciones complementarias y derogatorias
Artículo 1.- Vigencia de la Ley
La presente Ley entra en vigencia al día siguiente de su publicación en el Diario Oficial El Peruano.
Disposiciones finales
Artículo 1.- De la derogatoria.
Derogarse toda norma que se oponga a la presente Ley.

Congressman of the Republic Joshua Manuel Gutiérrez Condor, a member of the Nationalist parliamentary group Gana Peru, and the other congressmen involved, exercising their right of legislative initiative conferred by Article 107 of the Political Constitution of the State, in accordance with Articles 75 and 76 of the Rules of Congress, introduced the following bill:
Law to promote digital inclusion and implementation of Free Software in State institutions
The Congress of the Republic
has adopted the following law:
Article 1 -. Purpose of the Law
The institutions and enterprises of the Peruvian State will prioritise Free Software in their education and training programs, computer hardware, systems and projects. The use of open formats will ensure standardisation as well as interinstitutional interoperability in the exchange of data, processes, documents and information, in State organisations and entities encompassing all sectors of government. This will also guarantee respect for intellectual property rights.
Article 2 -. Use of Free Software
Government agencies should initiate this process of progressive and gradual migration toward implementing and using Free Software, through their various choices for information and data management. The executive power will create “Control Observatories” to monitor and control the implementation of this law.
Article 3 -. Legal and Administrative Responsibility
The National Office of E-Government and Information Technology (ONGEI — oficina nacional de gobierno electrónico e informática) will be responsible for compliance with the provisions of this Act.
Article 4 -. Independence
The State institutions shall not acquire hardware or machinery, nor sign contracts for equipments that require the use of a single specific type of software, nor limit in any way the use of Free Software. In the event of lack of support for this equipment, a certificate shall be issued by the responsible unit – the ONGEI.
Article 5 -. Exceptions
In the absence of suitable free software programs to fulfill a certain task, or if there is a risk of functional incompatibility with other software used in the public sector, the use of proprietary software will be allowed provided it is supported by prior studies and technical reports from the responsible unit – the ONGEI.
Article 6 -. Teaching Permissions
State-run educational institutions, whether schools, universities or technical, educational, agricultural and other higher institutes must include the use of Free Software in their curricula.
Article 7 -. Training
The National Office of E-Government and Information Technology (ONGEI) guarantees the principle that specialisation in the technologies, as well as training of staff and public sector officials, will be provided on terms of neutrality and technological sustainability.
Transitional Provision
Article 1 -. Regulation
The Executive must regulate within 180 days the conditions, timing and forms of migration from the current situation to the use of Free Software by all State institutions, in total compliance with this law.
Additional Provisions and Exemptions
Article 1 -. Coming into effect of the legislation
This Act will be effective as of the day following its publication in the Official Gazette of Peru (Diario Oficial El Peruano).
Final Provisions
Article 1 -. Revocation
Repeal any rule against this law.
